Terms and Conditions of Sale
Please read these terms of sale carefully before placing your order and retain a copy of these terms and your order for future references.

These terms and conditions apply to all wines and olive oils supplied by Azienda La Maddalena (ALM) di Schlegel Maria Magdalena to you. ALM is the trading name (company number REA AN-158454 and VAT number 0208 7300 428) whose registered office address is at via fuori il fosso N° 1, 60010 Monterado AN, Italy (“Azienda”, “we” or “us”).

You may order wines or olive oils by the various methods mentioned below. You will have the right to cancel such order, please see below for details.

Making a purchase
Making a purchase is easy. Just browse our catalogue, and click on any items that you wish to buy and put them in the shopping cart. After you have finished your selection, click on “Order” and you will be asked for a few details that we need to be able to satisfy the order. There will be no contract of any kind between you and us unless we accept your order. We may decline your order to supply the goods to you without giving any reason. At the moment we accept your order or in the case of delivery of goods, when the goods are dispatched, a contract will be made between you and us.

We accept bank transfers payable to Azienda La Maddalena. Orders may be delayed by transfer of money or credit card authorisations not being confirmed by the respective banks.

The description and prices payable for the items that you order are clearly outlined in our price list, brochure and/or website. If, by mistake we have under- or over-priced an item, we will not be liable to provide that item to you at the stated price provided that we notify you before we dispatch the item concerned or, in the case where we are not despatching an item within 2 working day of acceptance of your order and we may cancel your order provided we refund you any payment you have made. You may agree the correct price in which case we will proceed with your order.

We reserve the right to change our prices. Please refer to the latest price list or our website for all current prices. The latest price list or our website supersede any prices set out in these terms and conditions if they differ.

Prices listed for wines and olive oils are quoted per bottle and per case and include VAT. A case is equivalent to 6 x 75 cl bottles. Prices are subject to changes in duty and VAT. The case bottle price shows already the discount of 6% per case available when wines and olive oils are bought by the unmixed case.
Shipping and Handling
Orders can be delivered to Italy, Germany, Austria, France, Belgium, Luxembourg and the Netherlands. We may also deliver to other countries on request. The items are delivered from our Azienda here in Italy, or from one of our dealers in Germany (Munich and Bielefeld) or Belgium. Our acceptance information of your order states also the delivery station. In any case delivery to your address will be within 2 working days after accepting your order. The shipment will reach at least within 2 until 10 Workdays. We deliver in cases of 6,12 or 18 bottles. The transport costs for Italy are Euro 8 for up to 18 bottles and for up to 36 bottles Euro 16. Above that delivery will be free of charge. For other countries we are charging Euro 9 for a case of 6 bottles and for each further bottle Euro 0.70. Above 60 bottles (6 cases) delivery is free of charge.
Please try and specify an address where the recipient will be present. Delivery prices include full insurance cover, postage and packing and VAT.
Quality Guarantee
We are committed to providing our customers with superior quality wines and olive oils. Our winers are constantly controlled and checked before bottling to guarantee a steady quality. We accomplish the norms of HACCP Reg. 852/853/854/2004, that controls the processing standards regarding quality, hygiene and monitoring. Our top wines are closed with high quality corks from Sardinia. They are ISO certified and are permanently controlled and analysed. Therefore the risk from cork is completely minimised. Lower priced red wines are closed with granular corks of best quality. For other wines we are taking synthetic corks of high quality that have the same quality as natural corks.
If a wine is faulty or corked we will offer a replacement or credit on the return of the bottle in question. If a wine has been kept too long or stored inappropriately, we may not be able to offer a refund.
Return of Goods/Cancellation
All wines and olive oils are subject to availability. We try to ensure that all items remain available throughout the life of the list. If items go out of stock, we reserve the right to select and deliver to you a substitute of equal or superior quality of the wine or olive oil ordered, in order to avoid delay in delivery of orders. If we are unable to supply a particular item, or do not supply a substitute, you are not charged for that item. We reserve the right to part deliveries or to propose alternatives if the item you are ordering is not in stock.
Any other warranties, damages or other claims are excluded under all circumstances and titles

All return orders must include a minimum of Euro 100 for wine or olive oil. Returns are only accepted when they are closed with the original cork and at least ¾ full. All returned goods must be in re-salable condition otherwise no credit can be given. A collection charge of Euro 10 per order will be applied to all sale or return orders.
Copyright and Intellectual Property Rights
You agree that the design, trademarks, logos and intellectual rights to all parts of this web site belong to Azienda la Maddalena. These must not be used without prior permission for any purpose.
Applicable Law
Nothing in the terms and conditions limits or excludes your statutory rights as a consumer. The settling place for all cases is Via fuori il fosso, 60010 Monterado AN, Italy. Legal cases are settled in Senigallia, Italy.
Additional Information
Our Wine and Olive Oil Azienda is open to the public each Friday from 5 to 10 p.m. You are invited to pay us a visit. Please give previous notice by phone or e-mail.

In spring and autumn we offer a special low priced tour of wine and olive oil tasting at our place with overnight stay and breakfast and lunch. Please feel free to take up this offer.
